The Division of Disability and Rehabilitative Services, Services Provider Agreement details when and how an approved waiver provider must give notice to the waiver recipients it serves when planning a sale, merger or acquisition of its organization; closing a facility; or eliminating an approved waiver service. It is important to review and comply with the terms of the Service Provider Agreement before taking any action that may affect the delivery of services to waiver recipients. Today the Centers for Medicare & Medicaid Services (CMS) released an informational bulletin to states providing more information on implementation of provisions of the final regulation defining a home and community-based setting.
